EXPERT WITNESS

In the event of a dispute with a neighbour or a building contractor, it is always highly desirable to attempt to settle matters without reverting to Court action but in some disputes this is unavoidable. In such circumstances, there may be a need for the production of an expert witness report.

To be valid for inclusion within a Court submission, an Expert Witness report must be in compliance with the Civil Procedure Rules part 35 (CPR35).

Philip Smith, one of the two Directors at Smith Marston, has over 10 years experience of producing Expert Witness Reports for legal disputes and he has been accepted onto the RICS Expert Witness Registration Scheme, confirming the necessary level of expertise to act in this respect. Philip has appeared in Court as an Expert Witness on a number of occasions .

 

DISPUTES

In his role as Expert Witness, Philip has acted in cases regarding various types of building disputes between clients and building contractors and for a variety of neighbour disputes such as legal Right to Light matters and boundary disputes.

With particular respect to Boundary Disputes, Smith Marston LLP have the most up-to-date and accurate Nikon ‘Total Station’ technology, which allows for extremely accurate plan drawings to be produced. In comparison with more traditional tape or even laser distance meter methods of measuring, and combined with Philip’s many years of experience of boundary disputes, this provides a great advantage and confidence when potentially entering an expensive and complex legal dispute situation.
